RE: The tariff classification of gate fittings and a hinge from China

Dear Ms. Ames:

In your letter dated October 31, 2011, you requested a tariff classification ruling. A copy of the merchandise catalogue with pictures of the articles was submitted.

Product number C2360 is described as a Pressed Steel-Galvanized Gate Hinge. The hinge connects the gate to the fence, allowing a limited angle of rotation so that the gate can open and close.

Product number C2317 is described as a Pressed Steel-Galvanized Fork Latch Assembly. It is a latching device that attaches to a gate and enables the gate to be joined with a fence when closed. The fork latch is used on many types of gates.

Product number C6422 is described as a Malleable Iron Cantilever Roller. It attaches to the bottom of a cantilever and functions to allow the gate to roll open and closed. The cantilever roller is used on large industrial gates.

Product number C16229 is described as a Pressed Steel Single Wheel Carrier. It is comprised of a wheel and the steel mounting assembly that connects the wheel to the gate. It functions to allow the gate to roll open and closed. The single wheel carrier is used on large residential and industrial gates. The applicable subheading for the steel gate hinge will be 8302.10.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for base metal mountings, fittings and similar articles suitable for furniture, doors, staircases…hinges, and parts thereof, of iron or steel, of aluminum or of zinc, other, other. The rate of duty will be 3.5 percent ad valorem.

The applicable subheading for the steel fork latch assembly, iron cantilever roller and steel single wheel carrier will be 8302.49.6085, HTSUS, which provides for base metal mountings, fittings and similar articles suitable for furniture, doors, staircases…other mountings, fittings and similar articles, and parts thereof, other, other, of iron or steel, of aluminum or of zinc, other, other. The rate of duty will be 5.7 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the pressed steel scroll. Your request for a classification ruling should include a sample of the decorative scroll.
